Zaza Bibilashvili: The aim of the constitutional lawsuit is to confirm at the constitutional level the claim of the occupying state, Russia, that its military aggression in 2008 was legitimate

The aim of the constitutional lawsuit is to confirm at the constitutional level the claim of the occupying state that its military aggression in 2008 was legitimate because Georgia created the grounds for it, – this statement was made at the Constitutional Court by Zaza Bibilashvili, who is a representative of the “National Movement.”
At the session of the Constitutional Court where “Georgian Dream’s” lawsuit demanding the ban of five opposition parties is being examined, Zaza Bibilashvili noted that the use of the Constitutional Court for unconstitutional aims, including the ban of political parties, is considered a strong form of abuse of legal proceedings. In addition, he spoke about what, in his assessment, is the important aim of the lawsuit.
“An even more important aim of the lawsuit is to confirm at the constitutional level the claim of the occupying state, the Russian Federation, that its military aggression in 2008 was legitimate because Georgia created the grounds for it. I want to emphasize – not any particular party, but the then government of Georgia, accordingly your and my homeland, our state. One may argue that this is not the aim, but no one can argue that in the event the lawsuit is granted, the result will be precisely this – the legitimization of the Russian Federation’s military aggression at the level of a decision adopted by Georgia’s Constitutional Court.
The plaintiff side deliberately mixes political and legal responsibility, and also does not distinguish between the state and a party and draws no boundary between them. On the one hand, it considers decisions taken by concrete officials to be the responsibility of a party or parties, and on the other hand, it equates its own party with the state when it says that activity directed against their party’s policy is anti-state,” Bibilashvili stated.
